Mr. Kolb has defended employment claims for over 20 years before State and federal courts, administrative bodies and arbitration panels. He has successfully defended State and Federal discrimination, sexual harassment, retaliation, USERRA, FLSA overtime, wrongful termination, wage, and unemployment claims. He has fought FLSA overtime compliance audits by the U.S. Department of Labor, Wage and Hour Division, and has successfully litigated FLSA collective action overtime suits. He has successfully litigated ERISA and COBRA claims, defending both employers and plan administrators. He has drafted and successfully enforced and voided non-compete agreements in the petroleum, health care and financial services industries. Mr. Kolb draws on this experience to advise management on best practices and claims avoidance, and to oversee internal investigations. Mr. Kolb serves clients in the marine, healthcare, video retail, aerospace and electronics industries.
Mr. Kolb also has significant product liability experience, which includes defense work for Coca-Cola and Bausch & Lomb.
Mr. Kolb's insurance coverage and bad faith experience has focused on Life, Health, D&O, E&O, CGL, Maritime, Excess and Umbrella policies. He has provided coverage opinions, participated in mediations of liability claims as coverage counsel and has defended bad faith claims for over 20 years.
Prior to joining Ruden McClosky, Mr. Kolb was a partner with Beirne, Maynard & Parsons, LLP of Dallas, where he practiced in the areas of commercial litigation, insurance, labor & employment, and medical device product liability.
An AV rated attorney by Martindale-Hubbell, Mr. Kolb is a member of The Florida Bar, Labor & Employment and Trial Lawyer Sections as well as the State Bar of Texas, Insurance, Employment and Litigation Sections. He is admitted to the U.S. Court of Appeals for the 5th and Federal Circuits and is licensed to practice before the U.S. District Court, Northern, Southern, Eastern and Western Districts of Texas, and the Southern and Middle Districts of Florida.
