Mr. Sutton is Board Certified by The Florida Bar as a Health Law Attorney. A member of both the Litigation and Health Law Practice Groups, he is a trial lawyer who represents entities in criminal, civil and administrative disputes, including actions brought by government agencies and enforcement authorities. His practice focuses on commercial disputes, health care law and litigation, civil false claims and whistleblower actions, and white-collar criminal defense. During his career, Mr. Sutton has represented individuals and businesses in litigation and investigations brought by the U.S. Department of Justice, the U.S. Department of Health and Human Services, the Federal Bureau of Investigation, and State Medicaid Fraud Control Units. He also counsels healthcare clients on matters concerning the anti-kickback and physician self-referral laws, Medicare and Medicaid reimbursement disputes, corporate compliance plans, internal investigations, self-disclosure of regulatory violations, and disciplinary actions initiated by government licensing boards. He is AV® rated by Martindale-Hubbell.
Mr. Sutton began his legal career as a criminal trial counsel with the U.S. Army Judge Advocate General’s Corps, and served with the 24th Infantry Division during Operations Desert Shield and Desert Storm. Following military service, he joined the Florida Attorney General’s Office, serving first in the Economic Crimes Unit (RICO Section) and later as the Major Case Counsel to the Attorney General’s Medicaid Fraud Control Unit. In that capacity, he settled the first suit filed under the Florida False Claims Act, and represented the Attorney General’s Office during the State of Florida’s landmark suit against the tobacco companies. Immediately prior to entering private practice, Mr. Sutton served as an Assistant General Counsel to the Florida Agency for Health Care Administration, where he handled cases involving fraud and abuse, reimbursement, quality of care and regulatory compliance.
Mr. Sutton is recognized in The Best Lawyers in America, 2007 and 2008, and Florida Super Lawyers 2008 for Health Care Law.
Mr. Sutton also serves as the General Counsel for two proprietary healthcare companies with operations throughout the United States. As General Counsel to these entities, he provides legal counsel on contractual, regulatory, compliance, employment and litigation matters. Mr. Sutton draws on his experience as a general counsel to handle challenges and resolve disputes facing companies operating in highly-regulated environments.
