Debra L. Boje, J.D., LL.M., is a Florida Bar Board Certified wills, trusts and estates lawyer and an AV rated attorney. She focuses her practice in the areas of estate planning, probate, taxation, and family business succession planning.
Utilizing her extensive tax background, Ms. Boje develops estate plans for her clients that not only optimize tax savings but take into consideration the family dynamics of each client. Her process includes the drafting of trusts, wills, and beneficiary designations for retirement assets, the utilization of estate planning techniques such as the creation of family–owned limited liability entities and life insurance trusts, as well as the formulization and implementation of business succession plans, and when appropriate, asset protection plans. Ms. Boje’s practice also involves administration of taxable and non-taxable estates and trusts, including counseling clients in post-mortem planning techniques, trust reformations, and administrative obligations, as well as preparation of federal estate tax returns and fiduciary accountings. Litigation support in guardianship, probate and trust litigation matters is another significant aspect of her practice. She uses both her tax and administrative background to assist in a wide range of litigation matters representing beneficiaries, creditors and individual and corporate fiduciaries.
Ms.Boje serves on the Executive Council of the Real Property, Probate and Trust Law Section of The Florida Bar, and is a member of that Section’s Guardianship Law and Procedure Committee (current Co-Chair), Legislative Committee (current Co-Vice Chair), Probate Law and Procedure committee (Chair 2002-2006), Ad Hoc Trust Code Revision Committee, Durable Power of Attorney committee, Advance Directives Committee, and Estate and Trust Tax Planning Committee (former Vice-Chair). During her chairmanship for the Probate Law and Procedure Committee, she oversaw the drafting of proposed legislation for numerous statutory changes to the probate code. Notably, Ms. Boje was one of only 17 members of the Ad Hoc Trust Law Committee, responsible for creation of the new Florida Trust Code. Most recently, she has been appointed vice-chair of the Legislative Committee, where she will assist implementation of the Section’s proposed legislative changes to the Florida Probate Code and Trust Code, as well as the power of attorney and advanced directives statutes.
She is a frequent speaker at seminars organized by the Real Property, Probate and Trust Law Section, and for other audiences, on a variety of topics pertaining to estate planning, probate and guardianship law. She is a contributing author to Basic Estate Planning in Florida, Fourth and Fifth Edition, published by The Florida Bar. She has also served as co-chair of the Guardianship Guidelines Committee for the Thirteenth Judicial Circuit.
